Introduction

This privacy policy applies to your use of the website of PayUGuru hosted at payu.guru, the Services (as defined under the PayUGuru "Terms of Use") and PayUGuru applications on mobile platforms (Android, Windows, IOS etc.), but does not apply to any third-party websites that may be linked to them, or any relationships you may have with the businesses listed on PayUGuru. For the purpose of this Privacy Policy, the user of Services may be merchants/sellers/billers, customers/buyers/ consumers, or any other persons using Services or accessing Sites (“User”, “you” or “your”).This Privacy Policy will help you understand our policies and procedures regarding the collection,handling and use of your information. As the payments services are significantly dependent upon data or information shared by Our customers, we are committed to ensuring a secure environment for the processing of personal and sensitive personal information ("Personal Data" as defined hereunder)collected by Us from Our stakeholders.

Information Collected and how we use it-

PayUGuru collects, receives and stores your Personal Information. If you provide your third-party account credentials ("THIRD PARTY ACCOUNT INFORMATION") to us, you understand that some content and information in those accounts may be transmitted to your account with us if you authorise such transmissions and that Third Party Account Information transmitted to us shall be covered by this Privacy Policy. You may opt to not provide us with certain information, however that will restrict you from registering with us or availing some of our features and services.

PayUGuru uses commercially reasonable efforts to ensure that the collection of Personal Information of users is limited to only those, which are necessary to: help promote a safe service, calibrate consumer interest in our products and services, inform you about online offers and updates, troubleshoot problems, customize user experience, detect and protect us against error, fraud and other criminal activity, collect money, enforce our terms and conditions, and any others for the better functioning of the service. Any plan on the part of the gateway to use any other information of the user, in a manner different than the purpose for which it is collected, such information will be accessed only upon prior consent to such use, especially through revised Privacy Policies which are sent for the user acceptance from time to time.

If you create an account to take advantage of the full range of services offered on PayUGuru, we ask for and record-

  1. Personal Information such as your name, email address and mobile number.
  2. We may collect and store your Sensitive Personal Data or Information (such as any financial information including inter alia credit card, debit card details, bank account and know your customer ("KYC") documents as per RBI regulations and any other information as may be applicable) that the User may opt to save in the User account created with PayUGuru.
  3. We use your email address to send you updates, news, and newsletters (if you willingly subscribe to the newsletter during signup, or any time after). However, if a user does not want to receive such communications from us that are not relevant to you or your use of our services, please click on the unsubscribe link provided at the bottom of such e-mails sent to you by us.
  4. We use your mobile numbers to send you transaction alerts and SMS alerts based on your preferences. If you do not wish to receive such SMSs from us, please notify us at PayUGuru/support to stop receiving SMSs from us.
  5. We also store customer information of customers such as address, mobile number, Third Party Wallet details, Card details and email address making payments through PayUGuru checkouts. However, only when customer chooses to share the information on the businesses powered with PayUGuru applications we share the information to respective businesses. However, PayUGuru is not liable in any way for any misuse of this information by the business or people related to the businesses to whom the information is shared by the customer.
  6. We record information relating to your use of PayUGuru, such as the searches you undertake, the pages you view your browser type, IP address, location, requested and referring URL, and timestamp information. We use this type of information to administer PayUGuru and provide the highest possible level of security and service to you. We also use this information in the aggregate to perform statistical analyses of User behaviour and characteristics in order to measure interest in and use of the various areas of PayUGuru. However, you cannot be identified from this aggregate information.
  7. One Time Password (“OTP”) is a one-time password which is provided by your issuing bank in order to carry out the second factor authentication of your debit/credit card. If you opt for our ‘one tap’ feature, you understand that we will be able to retrieve your OTP from the message received on your mobile and populate and submit the OTP on the issuer’s page for second factor authentication of your debit/credit card.
  8. We may use the information we collect in connection with your use of PayUGuru (including your Personal Information) in order to investigate, enforce, and apply our terms and conditions and Privacy Policy.

We should clarify that all information stored by us is in accordance with our PCI DSS Certification. PayUGuru assures that your Personal Information will not be made public or sold to any third party.

The User shall have an option to erase any information provided by the User including Personal Information. If a user opts for the said option of erasure, PayUGuru shall delete all stored information of the User from its servers.

Provide a Loan on your requirement For providing payment aggregation, payouts and verification services to Our merchants and business partners and to comply with screening requirements as per Applicable Laws. Know Your Customer (KYC) documents including all proofs of identity and address, photograph, Permanent Account Number (PAN), GST Number, etc.
Payments related data For providing payment aggregation, payouts and verification services to Our merchants, business partners and end-customers and to comply with screening requirements as per Applicable Laws. Payment gateway ID, name of issuing bank, merchant’s name, category and other identifiers along with the details of products or services purchased or paid for, mode of payment, the date, currency and amount of the transaction(s), whether the payment was successful, and other information provided by You directly or indirectly to Us or provided to Us by banks, merchants or other service providers or business partners.
Log Data Statistical analyses of User behaviour and characteristics in order to measure interest in and use of the various areas of Our Services provided to You. Browser type, IP address, location, requested URL, referring URL, timestamp information, application, device, versions and configurations, operating systems, device brand and model, geo-location information, unique identifiers associated with Your device(s) and pages that You access on the website(s) to access or avail Our Services and paths taken.
Credit related Information For providing payment aggregation, payouts and verification services to Our merchants that are financial institutions or account aggregators under Applicable Laws, Our business partners and third-party service providers and end-customers. Your credit related information or assessment provided by third parties such as financial institutions or account aggregators under Applicable Laws including Our business partners and third party service providers.
Information provided by You directly to Us or received through Our merchants, business partners and third party service providers We may use third party services such as Google Analytics, who may collect, monitor and analyze this type of information in order to facilitate Our Services, to provide the Service on Our behalf, to perform Service-related services or to assist us in analyzing how Our Services are used. Your information may also be used to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email that We send. Account usernames and passwords; Your email address; Your preferred settings and themes, Communications with customer support, promotional and marketing campaigns, surveys, and records of Your subscriptions to marketing materials, or withdrawal, as the case maybe.(Note: We use "cookies" to collect information. No Personal Information is collected or used in this process. These third parties do not know or have access to the name, phone number, address, email address, or any Personal Information about PayUGuru's Users. PayUGuru Users can opt-out of sharing this information with third parties by deactivating cookies, the process of which varies from browser to browser.

Information Transfer, Dissemination/ Sharing-

We do not share your Personal Information with any third party apart from financial institutions such as banks, RBI or other regulatory agencies (as may be required) and to provide you with services that we offer through PayUGuru, conduct quality assurance testing, facilitate creation of accounts, provide technical and customer support, or provide specific services. These third parties are required not to use your Personal Information other than to provide the services requested by you.

We may share your Personal Information with our parent company, subsidiaries, joint ventures, or other affiliated companies under a common control that we may have now or in the future, in which case we will require them to honour this Privacy Policy. If another company acquires our company or our assets, that company will possess your Personal Information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.

We may disclose your Personal Information to third parties in a good faith belief that such disclosure is reasonably necessary to (a) take action regarding suspected illegal activities; (b)enforce or apply our terms and conditions and Privacy Policy; (c) comply with legal process, such as a search warrant, subpoena, statute, or court order; or (d) protect our rights, reputation, and property, or that of our Users, Affiliates, or the public.
Exceptions to Consent-based transfer-

Your Personal Data may be shared, without obtaining prior consent, with Government agencies mandated under the Applicable Laws or any law in India to obtain Your Personal Data for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences. Your account is password protected. We use industry standard measures to protect the Personal Information that is stored in our database. Governing Legal Provisions-

Your use of this Website will be governed by and construed in accordance with the laws of India. The Users agree that any legal action or proceedings arising out of your use may be brought exclusively in the competent courts/tribunals having jurisdiction in Nagpur Maharashtra in India and irrevocably submit themselves to the jurisdiction of such courts/ tribunals.

Retention of Information-

We retain Your Personal Data for no longer than is required for the purposes for which Your Personal Data is collected or for the period required to be maintained under the Applicable Laws. This largely means that the data may be retained even if the merchant is inactive, and in case of an individual using the gateway for such period of time as is deemed essential for smooth functioning of the services to the customers and for regulatory compliance.

Children Information-

We do not knowingly solicit or collect Personal Information from children under the age of 18 and use of our Platform is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are under the age of 18 years then you must use the Platform or services under the supervision of your parent, legal guardian, or any responsible adult.

  1. i. “Applicable Laws” shall mean the Information Technology Act, 2000, The Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, Payment and Settlement Systems Act, 2007, Prevention of Money Laundering Act, 2002, and any other applicable rules and regulations issued thereunder, including any guidelines, circulars, ordinance, order, judgment, notification, decree, bye-law, governmental restriction, or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law in India, whether in effect as of the date of this Policy or thereafter, as applicable to Us.
  2. “Password” means a secret word or phrase or code or passphrase or secret key, or encryption or decryption keys that one Uses to gain admittance or access to information.
